SALES CONDITIONS
(subject to Legislative Decree no. 206 of 2005 - Consumer Code, as reformed by Legislative Decree 21 February 2014, no. 21 for contracts concluded between consumers and professionals after the date of June 13, 2014)
Acceptance of sales conditions
By placing an order in the various ways provided below, the customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general conditions and the payment and shipping conditions reported below as well as the specific ones available on each product sheet.
With the acceptance, even partial, of the order, the contract between the seller Borelli Store srl with legal headquarters in Via dei Marmorari, Spilamberto (MO) is perfected. At the time of placing the order, it will be expressly indicated to the Customer that the order implies an obligation to pay.
Purchase procedure
It is possible to purchase with an electronic cart only the products present in the online catalog of the site at the time of the order, as described in the related information sheets. The images of the products visible on each product sheet are indicative. To purchase, simply add the desired products to the cart (by clicking on the buy button) and follow the on-screen instructions. At the end of the order, a summary email of the order with all the details relating to the purchase and the associated delivery timing will be automatically sent.
Prices
All prices listed on the site include VAT. Shipping costs are not included (unless otherwise specified). Shipping costs will be displayed during the order phase and the amount may vary depending on the type of product purchased. Price changes may occur without notice, but in any case, orders will be processed with the price indicated at the time of purchase.
Product availability and delivery times
The availability of each product is reported on its product sheet, with frequent updates. The purchased product will be delivered within the estimated term on the order. Services will be provided within the term specified in each offer, or will be agreed between the consumer and the service provider.

On the Griffeshop.com site, you can choose from several payment methods, all guaranteed according to the most modern security standards.
Payment by credit card
To ensure maximum security in payments, online transactions of your purchases paid by credit card are carried out with Verisign certification, through a Secure Server that adopts the SSL (Secure Socket Layer) protection system. This system encrypts the information typed, making it impossible for it to be intercepted. At the time of paying your order by credit card, you will be automatically sent to a secure page (SSL) of the bank's Internet site that will handle the transaction. In this page, you can enter your card data (number and expiration date) in absolute security. The data is in fact transmitted directly to the Bank, offering you the highest guarantee. Unlike what happens in a traditional commercial exercise (where the data of your card pass under the eyes of the owner, the clerk, the waiter) the online transaction becomes absolutely safe because no one (not even us) can know the codes of the Credit Cards used by its customers. The code is used only for the payment operation; if the payment is successful, the confirmation is immediate we receive from the Bank only a receipt number. No trace of the Credit Card code remains in any of our archives. * Griffeshop reserves the right to request additional information from the Customer (e.g. fixed telephone number) or the sending of documents proving the ownership of the Card used. In the absence of the required documentation, we reserve the right not to accept the order.
With your PayPal account
The operation of PayPal is very similar to that of a common bank account, after opening the account you can send or receive money, make online payments quickly. Moreover, PayPal respects the highest security standards on the market and has anti-fraud technologies that protect every transaction. If you already have a PayPal account and decide to purchase with this method, after sending the order you will be directed to the PayPal checkout page (secure and protected SSL transaction) where you just need to enter your access credentials chosen during registration to PayPal. If you want to use this payment method but are not registered with the PayPal service visit the site www.paypal.it. * Griffeshop reserves the right to request additional information from the Customer (e.g. fixed telephone number) suitable to determine the actual ownership of the PayPal account. In the absence of the required documentation, Griffeshop reserves the right not to accept the order.
Shipping methods and shipping costs
Our shipments are made via Express Courier. When shipments occur via express courier, following the departure of the ordered products the customer will receive an email with the shipment number (tracking number) with which they can follow and track the shipment in real-time. Such information will be sent directly by the shipping courier to ensure the customer 100% of the service. The goods are packed and delivered to the courier within the times and conditions reported above or specified on each product sheet. The delivery timing is indicated in your user panel inside each order sheet. The number of days required for delivery is to be considered only for working days. When the order is entrusted to the courier, the delivery times vary from 1 to 2 working days (islands and disadvantaged areas are excluded). The aforementioned delivery times are however indicative and may vary due to factors not due to our will (bad weather, strikes, ...). If cash on delivery the courier is instructed to collect the amount due before delivering the package (checks are not accepted). In case of absence, the courier can leave a notice or attempt delivery other times, after which the goods will be placed in storage at the competent office for a few more days. In case of collection at their office generally, no additional costs are envisaged. We advise the customer at the time of delivery of the goods to verify that the number of packages corresponds to that indicated on the transport document and that the packaging is intact and does not show damage or obvious alterations. In case of discrepancies, damages or obvious alterations, immediately contest such circumstances to the delivery person, by affixing on the document to be signed the wording "RECEIVED WITH RESERVE - damaged package". Only in this way will it be possible to charge the courier any damages resulting from the transport to delivery occurred. The limitation to the compensation due from the carrier - set nationally at 1 euro for each kg of gross weight of the goods lost or ruined. Otherwise, the package is considered correctly delivered. Refund In no way Borelli Store srl can be held responsible for shortcomings that occurred during transport.
Purchase documents
Each order will be accompanied by a DDT which can be used as a document attesting to the validity of the warranty.
Safety and responsibility
Borelli Store srl will not be responsible for any direct or indirect damages resulting from improper or non-compliant use of the products sold. It is recommended to carefully read the warnings and the manufacturer's instructions contained in the packaging. The marketed products comply with the standards and are approved according to the regulations of the European Community. Borelli Store srl does not provide the services subject to purchase on its site. The service provider specifically indicated in each promotional sheet is the subject responsible towards the consumer for compliance, safety, and in general the content and quality of the service.
Right of withdrawal
Every Customer who purchases on www.griffeshop.com has the right to withdraw within 14 days from the receipt of the goods.
The right of withdrawal gives you the opportunity to return the purchased product you are no longer interested in, and Griffeshop offers you the opportunity to return the item using the return procedure directly from your user panel in a few clicks; or you can notify us of your intention to withdraw by email or mail, as indicated in the return form.
Simply access your order history, select the order you wish to withdraw from, and follow the procedure in a few clicks. If you choose this option, we will send you an email confirmation of the receipt of the withdrawal.
The return is at Griffeshop's expense.
When the product is returned to our warehouses, Griffeshop will provide a refund or issue a credit with no expiration date that can be used on www.griffeshop.com
Note: The refund or credit issued will not include the initial shipping costs.
The withdrawal can be exercised within 14 days from the receipt of the goods. The return is Free and will be made at the expense of Griffeshop with its courier.

Exclusion of withdrawal:
In case you take advantage of the free return, the products must always be sent back in the original packaging.
Griffeshop will alert the customer if the items are not in compliance with the indications above. The customer can pick them up at our warehouses within 15 days.
Orders not picked up within the indicated terms, will be disposed of.
The management reserves the right to assess any anomalies and charge additional costs.
The right of withdrawal described above does not apply in the following cases:
a) service contracts after the complete performance of the service if the execution has started with the express agreement of the consumer and with the acceptance of the loss of the right of withdrawal following the full execution of the contract by the professional;
b) the supply of goods or services whose price is linked to fluctuations in the financial market that the professional cannot control and that may occur during the withdrawal period;
c) the supply of goods made to measure or clearly personalized;
d) the supply of goods that are liable to deteriorate or expire rapidly;
e) the supply of goods such as intimate products and swimsuits that are not suitable to be returned for hygienic reasons or related to health protection;
f) the supply of goods that, after delivery, by their nature, become inseparably mixed with other goods;
g) the supply of alcoholic beverages, whose price was agreed upon at the conclusion of the sales contract, whose delivery can only occur after thirty days and whose actual value depends on fluctuations in the market that cannot be controlled by the professional;
h) contracts in which the consumer has specifically requested a visit by the professional for the purpose of carrying out urgent repair or maintenance work. If, on the occasion of such a visit, the professional provides services beyond those specifically requested by the consumer or goods different from the spare parts necessary for performing the maintenance or repairs, the right of withdrawal applies to such additional services or goods;
i) the supply of sealed audio or video recordings or sealed computer software that has been opened after delivery;
l) the supply of newspapers, periodicals, and magazines except for subscription contracts for the supply of such publications;
m) after the third request for return within 12 months, the customer must bear the shipping costs at their own expense.
n) the supply of accommodations for non-residential purposes, the transport of goods, car rental services, catering services, or services related to leisure activities if the contract specifies a date or a period of performance;
o) the supply of digital content on a non-material medium if the execution has started with the express agreement of the consumer and with his acceptance of the fact that in such a case he would have lost the right of withdrawal.
Warranty
The warranty applies exclusively to consumers and cannot instead be enforced by professionals or companies that purchase products with an invoice or VAT number. Legal warranty of conformity Borelli Store srl (Griffeshop.com) is liable to the consumer for any lack of conformity that exists at the time of delivery of the goods that manifests itself up to two years from the delivery of the goods - the defect must be reported by the consumer to Borelli Store srl within two months of discovery, through appropriate documented notification. For conformity is meant that the consumer good:
a) is suitable for the use to which goods of the same type are usually used;
b) conforms to the description made by the seller and possesses the qualities of the goods that the seller presented to the consumer as a sample or model;
c) presents the usual qualities and performance of a good of the same type, which the consumer can reasonably expect, given the nature of the good and, if applicable, public statements on the specific characteristics of the goods made in this regard by the seller, the manufacturer or his agent or representative, particularly in advertising or on labeling;
d) is also suitable for the particular use wanted by the consumer and that has been made known to the seller at the time of the conclusion of the contract and that the seller has also accepted for conclusive facts.
In the case of a lack of conformity duly reported within the terms, the consumer has the right: - Primarily, to the repair or replacement of the product, at his choice, provided that the remedy requested is not objectively impossible or excessively burdensome compared to the other; - Subordinately (where the first two remedies are impossible, or were not timely adopted) a price reduction or termination of the contract can be requested. The remedy chosen is considered excessively burdensome that imposes unreasonable costs on the seller compared to the other, taking into account:
a) the value that the good would have if there were no lack of conformity;
b) the extent of the lack of conformity;
c) the possibility that the alternative remedy can be pursued without significant inconvenience to the consumer.
Repairs or replacements must be made within a reasonable time from the consumer's request. The timing depends on the type of product and the nature of the defect. Within the maximum term of 90 days, in case we are not able to return the repaired product, the product with a lack of conformity will be replaced with the same product or, if this is no longer available, with one having equal characteristics and functionality, or to the return of the amount paid.
Borelli Store srl certifies the originality of each of its promotions by having each Supplier sign a contract that obliges them to guarantee their customers the sale of original products, free of defects and complying with the current legal regulations. In the case of shipments of wrong products or damages from transport after appropriate verification, we will take charge at our expense of resolving the practice.
Refunds
Every refund will occur in the same manner used for the payment of the original order, unless a different agreement and provided that there are no costs as a consequence of the refund, or, at the customer's request, through a purchase voucher that will not expire and will not have any code; once made, it will automatically reduce the total of his new order.
Discount vouchers or promotional codes never confer the right to a cash refund. Therefore in case of their use for the payment of all or part of the purchase price, in case of return they will never be returned in cash but always in the form of a discount.
Particularly, by way of example, in the following cases:
- goods to be returned for Borelli Store srl error,
- goods to be returned or for right of withdrawal,
- goods to be returned for canceled order,
- goods not deliverable for unavailability.
Borelli Store srl, will only refund the cost of the item less the discount applied for that good (e.g., if a 10% code was used for the purchase, the refund will be the cost of the item subtracted by 10%).

Borelli Store srl guarantees the utmost respect for the data provided by customers and for the protection of their privacy.
Information
Borelli Store srl is the owner and responsible for the data provided by users under and in compliance with Legislative Decree 30.06.2003 n. 196 known as the privacy law.
Therefore, it has implemented an adequate policy for the protection and management of data.
Purpose
Navigation on the site is free and does not require registration. Only at the time of purchase will the data strictly necessary for the conclusion of the procedure be requested, that is for: - defining the contractual relationship and the consequent legal and fiscal obligations, as well as to allow effective management of financial and commercial relations.
The provision of the data requested is optional, but a refusal in this sense entails the impossibility for Borelli Store srl to conclude the contract and therefore provide products and services. - promotional communications, marketing activities or commercial information through the sending of emails or newsletters, which will instead be directed only to those who have made a specific request.
What personal data requested: Only the data necessary for the performance of the contractual relationship is requested, no "sensitive" (ex. religion, politics, health, sexual life etc.) or "judicial" data should be released. Communication and diffusion:
Your data will not be communicated and disseminated in any way, except in the ways and for the purposes mentioned above, for this purpose may access the data:

Rights on your data. Modification and Deletion
Under art. 7 of Legislative Decree 30.06.2003 you have the right to ask for confirmation, modify, delete your data or oppose their use (except, of course, you want to perfect the purchase).
